In ep 13 General Beardy's ADC or whatever Whatshername calls them something to the effect of "the commander's private forces consisting of relatives" and Nanoha refers to them as "the Yagami Family" at the end, which offers interesting insight into how Midchildan jurisdication views the matter. It could be theorized they're legally classified as something like familiars due to them being in essence magical lifeform sub-components of the <a href="http://acatisfinetoo.com/edible/nanoha/as_nano50.html" rel="nofollow">Book of Sava</a>... Darkness, which in turn is basically Hayate's Device - what now with an exceptionally strong (as in "'till (your) death do us part") bond with its owner.
